Mobile App Terms of Use

1. About these terms
These Terms of Use (“Terms”) govern your use of the Octopus Money Financial Solutions Limited mobile app (“the app”). By downloading, accessing, or using the app, you agree to these Terms. If you don’t agree, please don’t use the app.
Please read these Terms alongside our Privacy Policy, which explains how we handle your personal data, and your service terms, which govern the regulated services we provide to you. If there’s any conflict between these Terms and your service agreement, your service agreement takes priority for those services.
2. Who we are
The app is provided by Octopus Money Financial Solutions Limited, a company registered in England and Wales (company number 10339119), registered office: 7th Floor 33 Holborn, London, England, EC1N 2HT (“we”, “us”, “our”). Octopus Money Financial Solutions Limited is authorised and regulated by the Financial Conduct Authority (FRN 763630).
3. Who can use the app
- Be an existing Octopus Money customer who has been invited to take part;
- Be at least 18 years old
- Be resident in the United Kingdom.
- Please don’t share your access with anyone else.
4. Early access (closed release)
You’re one of the first people to use the app, and it’s still being improved. This means:
- The app is provided on an “as is” and “as available” basis
- It may be incomplete, contain errors, and behave unexpectedly from time to time;
- Features may be added, changed, or removed as we develop it, sometimes without notice
- It may be unavailable at times while we make changes.
By using the app during this period, you accept that it is still in development. None of this affects your legal rights as a consumer (see section 11) or your rights over your personal data.
5. Our regulated services
The app gives you a way to access and interact with services you already receive from us. Using the app doesn’t change the nature of the regulated services we provide.
6. Your account and keeping it secure
You’re responsible for keeping your login details safe and for activity that happens under your account. Please:
- Keep your password and any access codes confidential;
- Use the security features your device offers (such as biometric lock); and tell us straight away at support@octopusmoney.com if you think someone else has accessed your account.
7. Using the app properly
When using the app, please don’t:
- Use it for anything unlawful or fraudulent;
- Try to gain unauthorised access to the app, our systems, or other users’ data;
- Copy, modify, reverse-engineer, or interfere with the app or its security; or introduce anything malicious, or do anything that could damage or disrupt the service.
We may suspend or withdraw your access if you break these terms.
8. Availability of the app
Because the app is in active development, we can’t promise it will always be available or uninterrupted. We may change, suspend, or withdraw all or part of it, and we may end the closed release, at any time. Where we reasonably can, we’ll give you notice.
9. Your privacy and data
We take the security of your personal data seriously, and we apply the same security standards to your data across the app and our website. How we collect and use your personal data is explained in our Privacy Policy. Being part of the closed release doesn’t mean we collect any extra personal data about you.
10. Our responsibility to you
We’ll provide the app with reasonable care and skill. Because the app is at an early stage, we can’t guarantee it will be error-free or always available, and to the extent the law allows we aren’t responsible for losses caused by issues we couldn’t reasonably have foreseen or prevented.
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes liability for personal injury caused by our negligence, for fraud, and for any of your statutory rights as a consumer that can’t be excluded. Your legal rights as a consumer are not affected by these Terms.
11. If something goes wrong
If you’re unhappy with the app or our service, please tell us at support@octopusmoney.com so we can put it right.
12. Changes to these terms
As the app develops, we may update these Terms. If we make a significant change, we’ll let you know before it takes effect. Continuing to use the app after a change means you accept the updated Terms.
13. Ending your access
You can stop using the app at any time. We may end or suspend your access to the closed release at any time, including if you break these Terms or if we close the release. Ending your access to the app doesn’t end your wider relationship with us.
14. Governing law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
